Ninth Circuit Ruling May Encourage Class Action Plaintiffs to File in Federal Court

The Ninth Circuit’s recent plaintiff-friendly decision in Wang v. Chinese Daily News Inc., No. 08-56740 (Sept. 27, 2010), will likely result in more plaintiffs seeking certification of class action claims under Federal Rule of Civil Procedure 23(b)(2). In Wang, the Ninth Circuit affirmed a district court’s order certifying class claims for monetary damages under Rule 23(b)(2).
